Legal Biography

After graduating from The Ohio State University Moritz College of Law in Columbus, Ohio in 2006, Attorney Neiss assisted the Law Office of Michael J. O’Reilly, LLC in Pickerington, Ohio (2007 – 2008) with real estate litigation, land use law and business counseling.

After moving to Cleveland in the spring of 2008, Attorney Neiss opened the Law Office of Shadrach G. Neiss, ltd. where he developed a boutique business practice with a focus on commercial real estate transactions and commercial litigation, associating also with the firm of Chernett Wasserman, LLC (2011 – 2013) where he continued his work in commercial litigation and business counseling.

In 2013 Attorney Neiss opened a second office in Key West, Florida, where he expanded his counsel and advocacy to include serving private associations, state agencies, and government sponsored non-profit associations. Positions of note include serving as General Counsel and Executive Director of Human Resources at the Florida Keys Community College (2014 – 2015), administering labor and employment law, negotiating and drafting materials / services and employment contracts, and serving as the college Title IX hearing officer.

Attorney Neiss also independently revived and operated the Injunction for Protection Project in Monroe County, Florida (2019 – 2021), a free legal clinic funded by a federal grant that provided legal advice and emergency litigation advocacy to survivors of domestic violence, dating violence, sexual violence and stalking.

After relocating to New England, Attorney Neiss served as General Counsel and Commercial Director for Best Energy Services, Inc. (2022 – 2023), directing the company’s legal and commercial affairs including, without limitation, negotiating and drafting domestic and international specialty service contracts, and negotiating and resolving domestic and international commercial disputes.

When not practicing law, Attorney Neiss enjoys reading, writing, his family, his cats, managing his family’s investment company, making (so-so) music as a percussionist, and designing and producing high-fidelity loudspeakers.

  • Received a Summary Judgment Award on behalf of an elderly Plaintiff victimized by a fraudulent land installment scheme orchestrated by a neighbor in Cleveland, Ohio (2009).
  • Obtained a voluntary dismissal of all claims against clients falsely alleged to have damaged residential property in rural Northeast Ohio (2009).
  • Received an award of eviction and damages as well as a dismissal of all counter-claims on behalf of a Landlord against a holdover tenant following a bench trial in Cleveland Municipal Court (2010).
  • Successfully vacated a default judgment rendered against a client based on failure to secure proper service of process in Cleveland, Ohio (2010).
  • First chair litigant who organized an infrastructure improvement project with the municipality of Medina, Ohio involving a multifamily property and multiple adjacent property owners, settling litigation involving flooding problems created by storm water run-off (2011).
  • Successfully planned, litigated and negotiated a resolution to a complex commercial fraud case involving multiple overlapping ownership interests holding a portfolio of commercial retail and office property throughout central and northeast Ohio (2011).
  • First chair appellate advocate in Kennedy v Jacobs, 2012 Ohio 1404 (8th Dist. 2012), obtaining a unanimous reversal clarifying the trial court’s inherent authority to issue nunc pro tunc entries.
  • Successfully planned, litigated and negotiated a resolution on behalf of an investor victimized by a predatory jumbo mortgage loan, used to secure a multifamily property in Key West, Florida which included a covenant not to pursue contested, deficiency damages following a short-sale and a deletion of the contested trade lines on investors’ credit reports (2012).
  • Obtained a voluntary dismissal of a civil claim seeking cash damages against a tenant with compromised health who lawfully vacated a substandard apartment in suburban Northeast Ohio (2012).
  • First chair trial and appellate advocate, successfully settled a predatory lending case involving a commercial property scheme purchased and guaranteed by small investors in Cleveland, Ohio which included a covenant by lender not to pursue any contested, deficiency damages following a short-sale and a deletion of the contested trade lines on investors’ credit reports (2013).
  • Litigated and negotiated a successful resolution of mortgage debt on behalf of investors, used to secure a commercial bed and breakfast in Key West, Florida which included investors’ retention and transfer of the property’s municipal licensure rights and the waiver of deficiency damages following short sale (2014).
  • Successfully counseled and defended a commercial property investor in an emergency injunction hearing who lawfully and extrajudicially ejected a trespasser’s retail business in Key West, Florida following a bad faith business negotiation (2015).
  • Oversaw the successful acquisition, renovation, lease and transfer of commercial multifamily properties on behalf of a family investment company in Florida and Massachusetts (2017 – Present).
  • Qualified to receive referrals from Florida state courts as a private trial judge / arbitrator (2019) following requisite coursework and having served as a Title IX hearing officer at the Florida Keys Community College (2014 – 2015), reviewing civil rights complaints, taking evidence, conducting hearings, and issuing detailed legal opinions to dispose of controversies.
  • Saw substantial success in civil litigation, obtaining dozens of final judgment in over 90% of all trials and final, evidentiary hearings while operating the Injunction for Protection Project in Monroe County, Florida (2019 – 2021), a free legal clinic that provided legal advice and emergency litigation advocacy to over 160 survivors of domestic violence, dating violence, sexual violence and stalking.   • Drafted Amicus Brief and participated in oral arguments with State Attorney Dennis Ward during a successful appeal in Florida v McBride (2018-MM-125-AK, 16th Judicial Circuit), which in 2019 overturned trial court’s overly-broad discovery order against a domestic violence survivor to disclose the names and contact information of every intimate partner over the prior 10 years.
  • Successfully negotiated the full rescission of a timeshare agreement and promissory note with a national timeshare company on behalf of two fractional owners for fraud and violations of the consumer protection laws in South Florida without litigation (2021).
  • Successfully settled and resolved a long-standing controversy involving the partition of rental real estate in Rocky River, Ohio involving additional claims of conversion and fraud / self-dealing (2024).
